These procedures are ideal for preventing insolvency and preserving cash flow, as they allow you to spread your debts over a period of up to 10 years.

Treatment of a company in suspension of payments :

He also assists managers and their companies undergoing receivership or liquidation, at all stages of the proceedings. He works alongside the manager to file the declaration of cessation of payments (DCP), and in cases where a creditor requests the opening of receivership proceedings.

Creditor assistance :

Maître Indy MAUPETIT also assists creditors who wish to see their debtor placed in collective proceedings, or who are already confronted with them, in order to declare their claim, and if it is contested, to obtain its admission to the debtor’s liabilities by the bankruptcy judge.

Lastly, he assists managers facing personal or pecuniary sanctions, such as a ban on managing a business, personal bankruptcy or an action to make good liabilities.

Indy MAUPETIT assists the company director personally sued as guarantor, to obtain discharge of the commitments granted. He also assists directors who are the subject of proceedings to cover liabilities or a management ban.

After graduating from a Master 2 in Business Law at the University of NICE in 2016, Maître Indy MAUPETIT passed the Examination for Access to the Regional Center for Professional Training of Lawyers (CRFPA) in 2017.

He was sworn in by the Aix-en-Provence Court of Appeal on January 14, 2020.

After four years of profitable experience in law firms specializing in business law and distressed companies.

Maître Indy MAUPETIT decided to set up his own structure in order to put his recognized skills in business law and business criminal law at the service of his own clientele.

Fixed fee

Fees are assessed according to the difficulty of the case and the time required to process it.

A fee agreement is signed for each case. Any overruns are subject to prior agreement with the customer. An additional agreement must be signed for each new assignment.

Article 11 of the National Internal Rules of the legal profession stipulates that “(…) Fees are the subject of a written agreement which specifies the amount and method of determining the fees relating to foreseeable diligence, as well as the costs and disbursements envisaged. Fees take into account the client’s financial situation, the difficulty of the case, the costs incurred by the attorney, his reputation and the work performed. An additional fee may be charged according to the result obtained or the service rendered. The General Rules of Professional Conduct require the avocat aux conseils to show moderation and delicacy in setting fees, and allow him to demand payment prior to the completion of the work to which they relate (…)”.
